Gazetari gjerman Michael Martens ka reaguar pas vendimit të Dhomave të Specializuara të Kosovës ndaj ish-presidentit të Kosovës, Hashim Thaçi.
Përmes një postimi në X, Martens ka theksuar se procesi juridik ende nuk ka përfunduar, pasi vendimi i shkallës së parë mund të apelohet.
Sipas tij, zhvillimet në procesin gjyqësor nuk duhet të zbehin rëndësinë historike të asaj që ndodhi në Kosovë dhe të rolit që pati lufta për çlirimin e vendit.
Some preliminary thoughts on the verdict against Hashim Thaçi:
1. The Kosovo tribunal’s verdict against Thaçi was only the penultimate word in legal terms. An appeal is still pending. In view of the evidence, however, it seems both sound and right that Thaçi has now been convicted. At least based on what is currently known, it seems rather unlikely that an appeal could result in an acquittal. (Although such cases have occurred before—see Ante Gotovina.)
2. Whether the 25-year prison sentence imposed on Thaçi stands in a reasonable proportion to the sentences handed down to Serbian war criminals will be a matter for debate. I have my doubts.
3. Most importantly, however, the verdict should not blur the historical proportions of what happened in Kosovo in 1999 (and before). The conflict was triggered by the Greater Serbian policies of Slobodan Milošević, whch was, at least in the beginning, supported by a majority in Serbia. Serbian "security forces" (often just plain bandits on state payrolls) committed crimes on a far greater scale than those attributed to the “Kosovo Liberation Army” (UÇK). The court was therefore right to emphasize that neither Kosovo Albanians as a whole, nor the UÇK as such, nor its struggle for Kosovos independence were on trial in The Hague. In view of Serbian repression, that struggle was both inevitable and justified.
